Intellectual Property Resources - Kalamaras Law Office

Welcome to the KLO LAWTANK® - news, resources and links designed to assist in particular the small business owner.  In the pages that follow, we’ll attempt to educate you in particular about trademark, copyright and advertising law and answer the questions we are most frequently asked by our new clients.  To learn more, please click on our IP FAQs.

We hope that this information will help you decide to protect your own intellectual property and whether you decide to hire us or another law firm, we hope you’ll come away better informed.  If, at any time you have questions about this information, please contact us.  We provide a complimentary brief consultation to all new clients.  If you require a more in-depth consultation about your particular circumstances, we are happy to meet with you for up to an hour, for a nominal fee.

Our Process

Once we have our initial consultation and we both decide we’re a good fit, we’ll send you our standard engagement letter, as required by the Illinois Professional Rules of Conduct.  This letter outlines our fees, billing practices and all of our responsibilities to you and as well as the rights and responsibilities you have to us.  You will be required to sign the engagement letter and send it back to us, along with either payment in full or a provide us with a deposit before we can get started working for you.  We keep all client funds in a trust account, until the fees are earned.

The Trademark Process

No matter how quickly we are able to assist you, securing a Federal Registration is a lengthy process.  Given the backlog at the USPTO, the quickest one can secure a trademark registration is in about 14 months, and if you encounter issues with your application or your mark is opposed, the process could go on for two or more years.  We tend to see that the process takes much longer for pro se applicants (those trademark owners that try to navigate the application process on their own without the assistance of counsel) primarily because they are not familiar with the nuances of trademark law or the Trademark Rules of Practice.

Probably the number one question we get asked is about costs.  Costs can vary widely from law firm to law firm and from city to city.  We are not the least expensive law firm in this area, nor are we the most expensive by far.  I opened this practice because I wanted to share the knowledge and experiences I had with clients and businesses of all sizes.  At Kalamaras Law Office, we offer large law firm quality and service at small firm prices.  You always get the service of a partner level attorney when you engage Kalamaras Law Office who is responsive to your needs.

I am not a general practitioner.  All I practice is trademark, copyright and advertising law, and as a result, I know my areas of law very well.  But, price is not the number one consideration of my clients, and if it is your primary consideration, we likely won’t be a good fit.  The number one consideration my clients have is that they consider me a trusted advisor and someone they know they can trust with their business issues.  If you would like to learn more about our practice and how we work, please feel free to contact us.

Our Clients

Over the course of my career, I have represented clients from all walks of life in many different industries – small, multi-national corporations and everything in between – but they all have one thing in common.  All of our clients are interested in differentiating themselves among their competitors based on the strength of their brands.  It is for this reason they seek our legal assistance to help them identify, register, protect, enforce and commercialize their brands in the U.S. and abroad.

Getting Started

Please contact us to set up an initial complimentary consultation so we can learn more about you and your business and provide you with a budget based on your needs.  If we both decide we’re a good fit, we’ll send you our standard engagement letter.  You’ll be required to sign that letter.  Our firm policy is to require an advanced retainer from all new clients before we can begin our representation and, in some instances, full payment is required up front.  We look forwarding to working with you!
